Merchants Policy

When interacting with our services, the following agreement legally binds Nilepass.com users and associates.

2. TERMS AND CONDITIONS OF SERVICE

2.1 Provider shall facilitate Transactions by providing payment processing services under terms and conditions specified in this Agreement.

2.2 Nilepass users acknowledges that they will only transact in goods that are legal and in compliance with all applicable Sudan’s country laws.

3. FEES AND CHARGES

3.1 Nilepass: fees and charges are as detailed below:

a. Currency Swap Fee: Users agree to pay Nilepass.com a fee for each transaction swapped under this agreement. The standard Transaction fee currently is 3% of the total value of each Transaction. Transaction fees are deducted from the full transaction amount before it is deposited into the nominated account. Transaction Fee may change at any time with new agreements initiated by Nilepass.com.

b. Chargeback Fees: In the event of a chargeback, Nilepass.com administration has the right to fully investigate and arbitrate the disputed transaction. Users agree to corporate in all disputes and to accept all outcomes dictated by Nilepass.com.

c. Chargeback Fees: Users can defend against the chargeback claim by producing relevant evidence and documents with respect to the said chargeback case. The evidence relevant shall range from invoice, proof of delivery, ID proof and others.

d. All electronic Transfers, Deposits and Withdrawals are free. In the case of Cash Withdrawal currently available in Dubai and upon request to other places, Nilepass shall have no problems delivering this money into the hands of those who request it, however there is an administrative fee of $10 USD for Dubai and negotiable for other reaches.

e. All Withdrawals are subject to a period of processing as indicated, depending on the banking system used by our customers. It is advised to adhere to patience for the required time of process. 

3.2 Provider shall be authorised to deduct all fees and charges directly from processed payments or user designated balances.

4. Taxation

4.1 All users using Nilepass.com are advised to ensure that their individual tax obligations are fulfilled with accordance to the Sudanese laws and including internation users. Nilepass.com will NOT be responsible for any fulfilment of taxation responsibilities outside Sudan.   

5. Disputes and Refunds

5.1 Disputes are expected to be processed within 10-30days after it is raised. The length of this period is the minimum days required to process, however Nilepass.com will endeavour to ensure that disputes are responded to promptly.

5.2 When refund outcomes occur, it is expected that refunds are initiated within 3-4 working days of the accepted decision made.

6. Transaction Acceptance

a. The transaction represents a genuine sale of the Company’s goods or services to the Cardholder.

b. The transaction is not materially different than the transactions the Company has described to First Data with regard to the products or services sold, the procedures for payments acceptance, or the fulfilment of obligations to the Cardholder.

c. The transaction complies with all requirements of the applicable Network Rules and Industry Regulations, the laws of all relevant jurisdictions, and all other requirements of this Agreement.

d. The transaction is not a duplicate of any other transaction.

e. The transaction is authorised by the rightful Cardholder for the amount of the transaction in satisfaction of the Cardholder’s obligation to the Company.

f. The transaction is in payment of goods or services provided simultaneously with the payment transaction (except for delayed delivery, advance deposit, or other partial transactions specifically allowed under the Network Rules and Industry Regulations.

g. The transaction is not a refinancing of an existing obligation;

h. The transaction is valid, collectible, and is not subject to any dispute, setoff, or counterclaim; and

i. In the case of a refund, the transaction is submitted to reimburse the Cardholder for a sale transaction that was previously submitted.
